Civil Procedure, Torts, Real Property, Constitutional Law, and Evidence are five of the most important topics that are tested on the Multistate Bar Exam (MBE). The MBE is a 200-question multiple-choice test that asks you to apply black-letter law to fictional fact patterns. Most U.S. jurisdictions incorporate the MBE into their bar exam. Even if your jurisdiction’s bar exam doesn’t use the MBE, it will have a multiple-choice component that will be similar to the questions in this practice exam. To help you prepare for the experience of taking the MBE, we’ve put together this 60-question multiple-choice practice test that focuses on Civil Procedure, Torts, Real Property, Constitutional Law, and Evidence. After passing this practice test, you’ll be in better shape to pass the bar exam!

These multiple-choice questions are real questions that have been used on past MBEs. The National Conference of Bar Examiners (NBCE) has licensed the questions for use on this exam. The questions consist of fictional fact patterns that test at least one area of law. Some questions overlap in topics. The fact pattern is written to draw upon a particular legal issue and test your ability to apply black-letter law to hypotheticals. In real-world legal practice, clients will come to you with unfamiliar scenarios, and you’ll have to apply the law to those facts, so the MBE evaluates how well you do so under time-limited conditions.

Please note that with 60 multiple-choice questions, this practice test is shorter than the MBE. The MBE will have 200 multiple-choice questions spread out over two sessions: a morning and an afternoon session. Each session has 100 questions. But taking this shorter practice test will help you pass the MBE by giving you the chance to take real MBE questions under time-limited conditions. There isn’t a time limit built into this practice test, but you can time yourself using your watch, phone, or computer. We recommend spending one minute and forty-eight seconds on each question, as that’s the average time you’ll have available for each question on the real MBE. If you want to follow a strict overall time limit, you should set a time limit of one hundred and eight minutes (one hour and forty-eight minutes).
