What is Disclaimer?

In a written contract, a disclaimer declares a limitation of the party's liability. There may be a disclaimer of liability for warranties or for other damages. Disclaimers like this are common in the "terms and conditions" of internet websites, in order to keep litigation and claims against small businesses to a minimum. Both parties must affirmatively acknowledge and accept the disclaimer.
